Wills, Lasting Power of Attorney, Trusts and Probate

The principles of probate revolve around the legal process of administering a deceased person’s estate, ensuring their assets are distributed according to their Will (if one exists) or intestacy laws. Here are the key principles:
1. Verification of the Will
  • Probate involves confirming the validity of the deceased’s Will, ensuring it meets legal requirements and reflects their true intentions.

2. Appointment of Executors or Administrators
  • Executors (named in the Will) or administrators (appointed by the court if there is no Will) are granted legal authority to manage the estate.

3. Estate Valuation
  • A comprehensive inventory of the deceased’s assets and liabilities is conducted to determine the estate’s net value. This includes:
    • Bank accounts
    • Property
    • Investments
    • Debts and liabilities

4. Settlement of Debts and Liabilities
  • All outstanding debts, including loans, taxes, and funeral expenses, must be paid before distributing the remaining estate.

5. Tax Compliance
  • Executors or administrators are responsible for ensuring any applicable taxes are calculated and paid, such as:
    • Inheritance Tax
    • Capital Gains Tax
    • Income Tax (if relevant)

6. Distribution of the Estate
  • Once debts and taxes are settled, the estate is distributed according to the terms of the Will or, if no Will exists, in line with intestacy laws.

7. Duty of Care
  • Executors and administrators have a fiduciary duty to act in the best interests of the estate and its beneficiaries. This includes avoiding conflicts of interest, acting impartially, and keeping beneficiaries informed.

8. Legal and Procedural Compliance
  • Probate requires adherence to legal protocols, including filing necessary documents with the Probate Registry or relevant authority and obtaining a Grant of Probate or Letters of Administration.

9. Transparency and Accountability
  • Executors or administrators must maintain clear records of all financial transactions and provide a final account to beneficiaries.

10. Resolving Disputes
  • Probate also involves resolving any disputes, such as challenges to the Will, claims on the estate, or disagreements among beneficiaries.

By adhering to these principles, the probate process ensures the deceased’s wishes are honoured (where applicable) and their estate is handled fairly and lawfully.
